Please read these Terms & Conditions carefully before engaging our services. By accessing our website or placing an order, you agree to be bound by these terms.

Introduction

Welcome to WebEx Solutions (“Company”, “we”, “us”, or “our”). These Terms and Conditions govern your use of our website located at www.webexsolution.in and all services provided by WebEx Solutions, including but not limited to website design, web development, SEO, e-commerce solutions and ongoing maintenance and support.

These Terms constitute a legally binding agreement between you (“Client”, “you”, or “your”) and WebEx Solutions. By accessing our website, requesting a quote, signing a project agreement, or making any payment to WebEx Solutions, you acknowledge that you have read, understood, and agree to be bound by these Terms.

WebEx Solutions reserves the right to update or modify these Terms at any time without prior notice. Continued use of our services following any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.

Effective Date: These Terms are effective as of 1 January 2026 and supersede all prior versions. For questions regarding previous versions, please contact us directly.

Services Offered

WebEx Solutions provides professional digital services tailored for businesses across India. Our core service offerings include:

  • Website Design & Development: Custom-built, responsive websites for businesses including salons, clinics, pathology labs, restaurants, retail stores, educational institutions, and corporate firms.
  • E-Commerce Development: Online store setup with secure payment gateway integrations including Razorpay, PayU, and others applicable for Indian businesses.
  • Search Engine Optimisation (SEO): On-page and off-page SEO, schema markup, Core Web Vitals optimisation, and Google Business Profile setup.
  • Website Maintenance & Support: Periodic updates, security monitoring, backups, performance tuning, and bug fixes on a retainer or per-request basis.
  • UI/UX Design: Wireframing, prototyping, branding identity, and visual design using Figma or equivalent tools.
  • Domain & Hosting Assistance: Guidance and support for domain registration and web hosting setup (third-party services are subject to their own terms).
  • Banner, Pster & Logo: Banner, Poster, Logo and Card Designing as a add-on service for client.

The exact scope of services for each project is defined in a separate Project Agreement or Statement of Work (SOW) provided to the Client prior to commencement. Services not listed in the SOW are not included and will require a separate quote.

Project Engagement Process

All projects at WebEx Solutions follow a structured engagement process to ensure clarity, quality, and timely delivery. Engaging our services implies acceptance of this process.

3.1 Discovery & Proposal

Every project begins with a free discovery consultation. Based on the Client’s requirements, we prepare a detailed proposal including scope of work, estimated timeline, deliverables, and pricing. The proposal is valid for 15 calendar days from the date of issue.

3.2 Project Commencement

Work begins only after: (a) the Client provides written approval of the proposal, (b) the initial advance payment is received in full as per the payment schedule, and (c) the Client provides all required materials including brand assets, content, and login credentials where necessary.

3.3 Approvals

The Client is responsible for reviewing and approving deliverables at each milestone stage. Approval may be provided via email, WhatsApp, or our project management tool. Silence does not constitute approval — explicit written confirmation is required before we proceed to the next phase.

3.4 Feedback Turnaround

Clients are expected to provide feedback within 5 business days of receiving any deliverable. Delays in feedback from the Client’s side will result in a corresponding extension of the project delivery date, which WebEx Solutions shall not be held liable for.

Payments & Pricing

All prices quoted by WebEx Solutions are in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated. Prices are subject to change without notice; however, once a proposal is accepted, pricing is locked for that project.

4.1 Standard Payment Schedule
  • 50% Advance: Due prior to project commencement. Work will not begin until this payment is received and confirmed.
  • 25% Mid-payment: Due upon delivery and approval of the design phase (mockups/wireframes).
  • 25% Final Payment: Due prior to the final handover, launch, or delivery of all project files.
4.2 Payment Methods

We accept payments via UPI, NEFT/RTGS bank transfer, Razorpay (Debit/Credit Card, Net Banking), and Paytm Business. All payments must be made to the official WebEx Solutions bank account as communicated in the invoice. WebEx Solutions is not responsible for payments made to any unofficial account.

4.3 Late Payments

Invoices are due within 7 calendar days of issue. Payments not received by the due date may result in: (a) suspension of work until payment is cleared, (b) a late payment fee of 2% per month on the outstanding amount, and (c) witholding of all deliverables until the account is settled in full.

4.4 Refund Policy

Advance payments are non-refundable once work has commenced. If a project is cancelled by the Client after work has begun, the advance paid covers work already completed and will not be returned. Refunds are only applicable if WebEx Solutions is unable to deliver the agreed scope of work.

4.5 Third-Party Costs

Costs related to third-party services — including domain registration, web hosting, SSL certificates, stock photography, premium plugins, payment gateway fees, or any external API subscriptions — are not included in our project fees unless explicitly mentioned in the proposal. Such costs are the Client’s responsibility.

Intellectual Property Rights

Intellectual property matters are taken seriously at WebEx Solutions. This section outlines the ownership of all creative and technical work produced during a project.

5.1 Ownership Transfer

Upon receipt of full and final payment for a project, all rights, title, and interest in the custom-designed and custom-developed deliverables are transferred to the Client. This includes website design files, source code, content layouts, and graphic assets specifically created for the project.

5.2 WebEx Solutions Retained Rights

WebEx Solutions retains the right to:

  • Display the completed project in our portfolio, case studies, and marketing materials unless the Client requests confidentiality in writing.
  • Retain and reuse generic frameworks, libraries, code snippets, templates, and design patterns that are not exclusive to the Client’s project.
  • Use screenshots, performance data, or descriptions of the project for promotional purposes in an anonymised or attributed manner.
5.3 Client-Provided Materials

The Client warrants that all text, images, logos, videos, and other materials provided to WebEx Solutions are owned by the Client or that the Client has obtained the necessary permissions to use them. The Client accepts full liability for any intellectual property infringement arising from such materials.

5.4 Open-Source & Third-Party Components

Projects may incorporate open-source libraries, WordPress themes, or third-party plugins. These remain subject to their respective licences (e.g., GPL, MIT). WebEx Solutions does not transfer ownership of third-party components and will disclose their use in the project documentation.

Client Responsibilities

The successful delivery of any project requires active and timely participation from the Client. By engaging WebEx Solutions, the Client agrees to fulfil the following responsibilities:

  • Provide Accurate Information: Supply complete, accurate, and final content — including text, images, brand guidelines, and product information — in the format and timeline agreed upon.
  • Timely Communication: Respond to queries, review requests, and approval requests within the agreed timeframes. Delays caused by the Client will extend the project timeline accordingly.
  • Designate a Point of Contact: Appoint a single authorised person to communicate decisions, approvals, and feedback to avoid conflicting instructions.
  • Provide Access: Supply necessary credentials for domain registrars, hosting accounts, social media, or other platforms when required for the project.
  • Legal Compliance: Ensure that all content, business practices, and services mentioned on the website comply with applicable Indian laws and regulations.
  • Content Accuracy: Take full responsibility for the accuracy, legality, and appropriateness of all content published on the website. WebEx Solutions is not responsible for errors in Client-supplied content.
  • Backup Responsibility Post-Handover: After project handover, the Client is solely responsible for maintaining backups and upkeep of the website unless a maintenance retainer is in place with WebEx Solutions.

Revisions & Change Requests

We want every client to be completely satisfied with the final deliverable. Our revision policy is designed to be fair and transparent.

7.1 Included Revisions

Each project includes a set number of revision rounds as specified in the proposal. Standard packages include:

  • Design Phase: Up to 3 rounds of revisions on wireframes and visual mockups.
  • Development Phase: Up to 2 rounds of content/layout adjustments post-development.
  • Final Review: 1 round of minor tweaks prior to launch (text corrections, colour adjustments, alignment fixes).
7.2 Additional Revisions

Revisions beyond the included rounds, or changes that involve a significant shift in scope, design direction, or functionality, will be treated as change requests and billed separately at our standard hourly rate of ₹300/hour or as a fixed-fee quote, whichever is applicable.

7.3 Scope Creep

Important: Any new features, pages, or functionality requested after the project has commenced — and not included in the original SOW — constitute scope creep and will require a revised proposal, additional cost, and may extend the project timeline.

Delivery & Timeline

WebEx Solutions is committed to delivering projects on time. Estimated timelines are provided in each project proposal and are contingent on both parties meeting their respective obligations.

  • Standard Website: 7–14 business days from receipt of all required content and advance payment.
  • E-Commerce Website: 15–25 business days depending on the number of products and integrations.
  • Custom Enterprise Projects: Timeline agreed upon in the individual SOW.

Timelines begin only after receipt of the advance payment and all required materials from the Client. WebEx Solutions shall not be liable for delays resulting from: (a) late supply of content or assets by the Client, (b) delayed Client approvals, (c) third-party service outages (hosting, domain registrar, payment gateways), or (d) force majeure events.

⚠️

If a project is placed on hold by the Client for more than 30 calendar days, WebEx Solutions reserves the right to archive the project. Reactivation will require a re-scoping discussion and may incur additional costs.

Confidentiality

Both parties agree to maintain the confidentiality of sensitive information shared during the course of the project. “Confidential Information” includes but is not limited to: business plans, financial data, login credentials, customer data, trade secrets, and proprietary processes.

  • WebEx Solutions will not disclose the Client’s confidential information to any third party without prior written consent, except as required by law.
  • The Client will not disclose WebEx Solutions’ pricing structures, internal processes, source code templates, or proprietary methodologies to third parties.
  • Confidentiality obligations survive the termination of the project or agreement for a period of 3 years.
  • Credentials and access details shared with WebEx Solutions will be stored securely and deleted upon project completion unless a maintenance agreement is active.

If the Client requires a formal Non-Disclosure Agreement (NDA), this can be arranged prior to project commencement. Please notify us during the initial consultation.

Limitation of Liability

To the maximum extent permitted by applicable law, WebEx Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with the services provided, including but not limited to:

  • Loss of revenue, profits, or business opportunities resulting from website downtime, errors, or performance issues after handover.
  • Data loss, security breaches, or hacking incidents occurring after project delivery and handover to the Client or their hosting provider.
  • Third-party service failures including hosting outages, domain expiry, payment gateway errors, or SSL certificate lapses.
  • Inaccuracies in Client-supplied content that result in legal, financial, or reputational harm.
  • Search engine ranking changes, algorithm updates, or penalties affecting the Client’s website after project delivery.

In any event, WebEx Solutions’ total cumulative liability shall not exceed the total fees paid by the Client for the specific project giving rise to the claim. Claims must be raised in writing within 60 days of the issue arising.

Termination of Services

11.1 Termination by the Client

The Client may terminate a project at any time by providing written notice. Upon termination, the Client shall pay for all work completed up to the date of termination. Advance payments already made are non-refundable. Any deliverables completed and paid for will be handed over to the Client.

11.2 Termination by WebEx Solutions

WebEx Solutions reserves the right to terminate a project or suspend services with written notice if the Client:

  • Fails to make payments by the due date after a 7-day grace period.
  • Engages in abusive, threatening, or disrespectful conduct towards our team.
  • Requests deliverables that violate applicable law, promote illegal activity, or infringe third-party rights.
  • Provides materially false information that affects the scope, pricing, or feasibility of the project.

In cases of termination by WebEx Solutions due to Client misconduct or non-payment, no refund of advance payments shall be issued.

11.3 Post-Termination

Upon termination, each party shall return or destroy confidential information belonging to the other party. WebEx Solutions will retain project files for 90 days post-termination, after which they may be permanently deleted.

Warranties & Disclaimers

WebEx Solutions warrants that:

  • All services will be performed with reasonable professional skill and care.
  • Delivered websites will function as described and agreed upon in the proposal at the time of handover.
  • A 30-day bug-fix warranty applies after project delivery — any functional issues directly attributable to our work will be resolved at no additional cost within this period.

The 30-day warranty does not cover issues arising from: (a) changes made by the Client or third parties after delivery, (b) hosting server issues, (c) third-party plugin updates, or (d) content changes made post-handover.

WebEx Solutions does not guarantee specific search engine rankings, visitor numbers, conversion rates, or business outcomes. SEO results depend on numerous factors outside our control, including Google algorithm changes and competitor activity.

Privacy & Data Protection

WebEx Solutions is committed to protecting your personal information. When you contact us, place an order, or use our website, we collect data necessary to provide our services. This may include your name, email address, phone number, business information, and payment details.

  • Data Use: Collected information is used solely for delivering services, issuing invoices, communicating about your project, and improving our offerings.
  • No Data Selling: We do not sell, rent, or trade your personal data with third parties under any circumstances.
  • Data Storage: Data is stored securely on servers located in India and is protected using industry-standard encryption and access controls.
  • Cookies: Our website may use cookies to enhance your browsing experience. You may disable cookies in your browser settings, though this may affect site functionality.
  • Third-Party Sharing: We may share data with trusted partners (e.g., payment processors, hosting providers) strictly for the purpose of service delivery, and only as necessary.
  • Your Rights: You have the right to request access to, correction of, or deletion of your personal data at any time by contacting us at support@webexsolution.in.

Governing Law & Disputes

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, specifically under the jurisdiction of the courts of Mumbai, Maharashtra.

14.1 Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the services provided, the parties agree to first attempt to resolve the matter through good-faith negotiations within 30 days of the dispute being raised in writing.

14.2 Arbitration

If the dispute cannot be resolved through negotiation, it shall be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 of India. The arbitration shall be conducted in Mumbai, Maharashtra, in the English language. The decision of the arbitrator shall be final and binding on both parties.

14.3 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
